3. Client Responsibilities
Clients are expected to provide accurate and complete information required for project execution. This includes content, branding materials, and timely feedback. Delays caused by the client may affect project timelines and delivery dates.
4. Pricing and Payment Terms
All services are charged based on agreed quotations. A deposit (usually 50%) is required before work begins unless otherwise agreed. The remaining balance must be paid upon completion or before final delivery of files. Late payments may attract additional charges or delay delivery.
5. Revisions and Changes
Benard Creatives offers a limited number of revisions as agreed in the project scope. Additional revisions or major changes beyond the agreed scope may incur extra charges.
6. Project Timelines
Project timelines are estimated based on the scope of work and client cooperation. While we strive to meet deadlines, delays caused by unforeseen circumstances or lack of client feedback may affect delivery schedules.
7. Intellectual Property Rights
Upon full payment, the client receives ownership rights to the final approved work unless otherwise stated. Benard Creatives reserves the right to showcase completed projects in portfolios and marketing materials unless the client requests confidentiality in writing.
8. Cancellation and Refund Policy
If a project is canceled after work has begun, the initial deposit is non-refundable. Refunds may be considered only if no work has been started. Any completed work up to the cancellation point will be billed accordingly.
9. Confidentiality
Benard Creatives respects client confidentiality and will not disclose sensitive information shared during the course of a project. Clients are also expected to respect proprietary methods and materials used by Benard Creatives.
10. Limitation of Liability
Benard Creatives is not liable for any indirect, incidental, or consequential damages resulting from the use of our services. We do not guarantee specific business results such as increased sales or online engagement.
11. Third-Party Services
Some projects may involve third-party tools or platforms (e.g., hosting services, advertising platforms). Benard Creatives is not responsible for issues arising from these external services.
12. Termination of Services
We reserve the right to terminate services if the client violates these terms, engages in unethical practices, or fails to meet payment obligations.
13. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of Kenya.
